Digital Millennium Copyright Act (DMCA) Policy
Last Updated: October 7, 2026
This Digital Millennium Copyright Act policy ("Policy") applies to the winzland.com website ("Website" or "Service") and any of its related products and services (collectively, "Services"). It outlines how Winz Land ("we", "us" or "our") addresses copyright infringement notifications and how you ("you" or "your") may submit a copyright infringement complaint.
NO USER-GENERATED MEDIA HOSTING: Winz Land operates as a proprietary corporate platform. We do not permit public users, clients, or third parties to upload, host, publish, or share image, video, or media files on our Website. Consequently, the risk of third-party copyright infringement via user-generated content on our servers is strictly mitigated, rendering DMCA Safe Harbor registration unnecessary. All media assets displayed on the Website are the exclusive proprietary assets of Winz Land or its authorized licensors.
It is the strict policy of Winz Land to expeditiously respond to clear notifications of alleged copyright infringement that comply with the United States Digital Millennium Copyright Act ("DMCA") of 1998, the text of which can be found at the U.S. Copyright Office website.
International Users
This DMCA Policy is based on the rigorous requirements of United States copyright law. While Winz Land respects the intellectual property rights of creators worldwide, copyright processes and remedies may vary across jurisdictions. If you are located outside the United States and believe your copyright has been infringed on this Website, you are encouraged to contact us; however, your claim will be exclusively governed by applicable U.S. copyright law and DMCA standards.
Repeat Infringer Policy
In strict accordance with the DMCA and other applicable international laws, Winz Land has adopted a policy of terminating, in appropriate circumstances and at our absolute sole discretion, users who are deemed to be repeat infringers. We may also, at our discretion, limit access to the Website and/or terminate the accounts of users who infringe upon any intellectual property rights, regardless of whether there is any repeat infringement.
Digital or Physical Signature Requirement
Your DMCA Notification must include a physical or digital signature of the person legally authorized to act on behalf of the copyright owner. Incomplete notifications or those lacking proper legal authority will be dismissed at our discretion.
Misrepresentation Penalties
Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to severe legal liability. Please ensure that all claims submitted are made in absolute good faith.
Considerations Before Submitting a Copyright Complaint
Before submitting a formal copyright complaint to Winz Land, consider whether the use could be legally defined as "fair use." Fair use states that brief excerpts of copyrighted material may, under certain circumstances, be quoted verbatim for purposes such as criticism, news reporting, teaching, and research, without the need for permission from or payment to the copyright holder. If you have considered fair use and still wish to proceed, you may want to first reach out to the user in question to resolve the matter directly.
If you are unsure whether the material you are reporting is in fact infringing, it is highly recommended that you consult independent legal counsel before filing a notification with us.
We may, at our discretion or as required by law, share a full copy of your notification or counter-notification with third parties. This may include sharing the information with the account holder engaged in the allegedly infringing activity. If you are concerned about your information being forwarded, you may wish to utilize a legal agent to report infringing material on your behalf.
Notifications of Infringement
If you are a copyright owner or a legally authorized agent thereof, and you believe that any material available on our Services infringes your copyrights, you may submit a written copyright infringement notification ("Notification") using the contact details below pursuant to the DMCA. All such Notifications must strictly comply with DMCA requirements.
Filing a DMCA complaint initiates a pre-defined legal process. Your complaint will be rigorously reviewed for accuracy, validity, and completeness. If your complaint satisfies these requirements, our response may include the immediate removal or restriction of access to the allegedly infringing material.
If we remove or restrict access to materials or terminate an account in response to a Notification, we will make a good faith effort to contact the affected user with information concerning the removal, which may include a full copy of your Notification (including your name, address, phone, and email address), along with formal instructions for filing a counter-notification.
Notwithstanding anything to the contrary contained in any portion of this Policy, Winz Land reserves the absolute right to take no action upon receipt of a DMCA copyright infringement notification if it fails to strictly comply with all the requirements of the DMCA.
Counter-Notifications
A user who receives a copyright infringement Notification may make a counter-notification pursuant to sections 512(g)(2) and (3) of the US Copyright Act. If you receive a Notification, it means that the material described has been removed from our Services or access has been restricted. To file a counter-notification with us, you must provide a written communication strictly compliant with all DMCA requirements.
If you are not sure whether certain material infringes the copyrights of others or believe that the material was removed by mistake or misidentification, you should consult an attorney before filing a counter-notification.
Notwithstanding anything to the contrary, Winz Land reserves the right to take no action upon receipt of a counter-notification. If we receive a counter-notification that complies with the terms of 17 U.S.C. § 512(g), we may forward it to the person who filed the original Notification. The process described in this Policy does not limit our ability to pursue any other legal remedies we may have to address suspected infringement.
Changes and Amendments
We reserve the sovereign right to modify this Policy or its terms related to the Website and Services at any time at our discretion. When we do, we will post a notification on the Website. We may also provide notice to you in other ways at our discretion, such as through the contact information you have provided.
An updated version of this Policy will be effective immediately upon the posting of the revised Policy unless otherwise specified. Your continued use of the Website and Services after the effective date of the revised Policy will constitute your unconditional consent to those changes.
